Habeas Corpus


Being a law student a.k.a 'law' friend will made you as a reference if there is any legal questions coming into our 'layman' friends’ minds. They keep asking you as you know everything.

As saying goes, Lawyers like to pretend as they know everything even they do not know everything but they know how and where to find it.

That is the secret actually. I guess so.

1 of my friend (engine student) asked me, what is habeas corpus?

The term of Habeas Corpus famously/ frequently used in the newspaper in this 2 weeks time especially after the incident of Hindraft Assembly.

Newspapers also put it as a part of headline in their news. I keep wonder how the normal person a.k.a layman will understand when the title is Habeas Corpus Writ . Supposedly the journalist should put the definition of it since the word is rarely used in normal days. Me myself, keep wondering what is the meaning of this writ since I haven’t met this term before.

I search the internet and even open my lovely Oxford Law Dictionary in understanding the meaning of Habeas Corpus.

Finally, I got the simplest way how to explain to my friend who asked me.

“ Habeas Corpus is a writ used to challenge the validity of a person’s detention either in official custody or in private hands.”

In other words it means that is is a writ sent by the counsel in order to challenge the validity of the person’s detention.

As the time goes, Im sure it totally related to the Hindraf issues. Please refer to my earlier post about : Ethnic Cleansing.

Anyway, It is good to know everything. But as a human being, we cannot afford to do so. So the best way is we must know where to fine the source about any matters at a right place. I am sure all the people who are in the law field will agree with this method even my lecturer as we are all human beings.. Memorising all the cases around the world is ridiculous since we have a billion of cases.

Teman SAMBEST

Cepatnya masa berlalu. Cuti hampir seminggu ni rasa macam sekejap sangat. Aku selalu teringat cuti sampai rabu. Rupa-rupanya sampai besok je. Tapi dapat berborak dengan kawan lama, kira oklah tu. Kalau dah kat UIA tu, nak cari masa ber’online’ susahlah jawabnya.

Thanks to Asma’. Lama sih dah tak berborak dengan ko. Macam-macam cerita ko. Yang pasti aku nak stoking comel satu.

Kepada Esma, sahabat segeng ku ketika di SAMBEST, selamat ber’fly’. Belajar elok-elok kat UK tu. Bangga aku jadi kawan ko. Bilalah aku berpeluang berjumpa dengan ko lagi pas ni.

Kepada Afrah a.k.a, thanks for hearing my story. Doakanlah Along mendapat revealation dalam menghadapi cabaran hidup ni.

Nak letak gambar kekawan time sekolah menengah takdelah pulak simpanannya. Biasalah saya mana tahu pegang kamera masa dulu. Hahaha

Takpe, walaupun xda, muka korang masih lagi dalam ingatan hamba dan nama kalian ada terpahat dalam hati ini.

Wanie, Miza, Olie, Nazurah, Dija Lilah, Nad F, Nad A, Faim, Ayman and especially Yati..… Waa apsal tetiba aku teringat sama kekawan aku ni….Itulah orang kata, A friend in deed, is A friend in need. Yeke?Aku rasa ubah sikit. A friend in need is a friend in Deen. Insyallah.

Reunion FV

" Besarnya ko…” reaksi spontanku melihat seorang teman sekolahku ketika di reunion batch aku di SAMBESTARI ahad lalu. Bukanlah aku berniat hendak mengejek atau apa, tetapi memang dah membesar. Bahagia mungkin bakal pilot kita ini. Hahaha.

Anyway, memang perjumpaan itu boleh dikatakan Berjaya. Ramai rakan-rakanku kutemui setelah sekian lama tidak berjumpa untuk hampir 2 tahun lamanya. Mmm sekarang semua boleh dikatakan berjaya. Semua rakan-rakan kami yang sebatch boleh dikatakan semuanya berada di dalam institusi pendidikan. Tiada yang tersangkut. Bak kata Gg, MC kami pada hari tersebut.

Pertemuan tersebut membawa pelbagai kisah baru. Semua sibuk meng'update' cerita-cerita baru daripada rakan-rakan masing-masing. Ada yang dah bertunang. Ada yang menulis dan menerbitkan buku syair arab. Ada yang menulis buku motivasi. Semuanya dah lain. Berbeza dengan keadaan kami ketika di sekolah menengah dulu. Semua dah meningkat dewasa.

Cuma satu perkara yang tidak boleh diubah. Bila kita berkumpul bersama-sama rakan sebatch, aku rasa macam kembali semula ke zaman dulu-dulu. Zaman suka huha sana sini. Bising. Kecoh. Hahaha. Memang best r dapat jumpa kawan-kawan especially Piyah and Adi. My best member kat SAMBEST dulu. Tapi adakah aku perasan aku sudah berubah bila aku keluar dari SAMBEST? Tidak bising dan sebagainya. Usahlah Rehan. Ko hanya bermimpi. Mungkin itu yang akan orang lain cakapkan kat dirimu. Dirimu sudah dikenali dengan fi’il macam tu. Hahaha

Thanks to Fahimah Hambari a.k.a Faim for the effort to make the event succeed. I think without you, this event cannot make it. Agak susah mahu dikumpulkan batch kita ini. Tapi alhamdulillah semuanya berjalan lancer seperti yang dirancang. Lepas ni bilalah pula gathering yang seterusnya. 2 tahun lagi mungkin? Agaknya di kala itu ada yang dah kahwin. Ada yang dah bekerja. Ada yang dah habis belajar. Macam-macam. Begitu cepat masa berlalu. Sampai tak sangka kita semua sudah meningkat dewasa. Semoga member-memberku berjaya di dunia mahupun di akhirat juga.

Etnic Cleansing in Malaysia?

I am shocked when I watched the news just now. Our Prime Minister, Pak Lah looked so angry as he always known as the patient one. If I were in his shoe, I will be the same as his. The accusations from the HINDRAF memorandum are nonsense. There are 3 issues mention in the News but the most I want to highlight is the first issue : APPEAL FOR U.K TO MOVE EMERGENCY U.N RESOLUTION CONDEMNING "ETHNIC CLEANSING" IN MALAYSIA.

Ridiculously, this accusation is totally wrong. I don't know from which earth this issue comes out. Malaysia is a “Muhibbah Country”. If not, I am sure right now, Malays, Chinese and Indians cannot seat together in this country. Even, the whole world is respecting us for that. We respect for others religion and cultures. We even celebrate others festival together. We even have the Government Minister which consists of all races in Malaysia. Since the Prime Minister is a Malay, it does not means the other races cannot have their freedom in this country.

, we have the laws which protected the fundamental liberties including the freedom to learn, freedom of religion, freedom of speech and many more.


Malays always tolerate with other racist. During the pre-independent process, 1 of the condition for Federation of Malaya to have their own independent state from the British was to allow Chinese and Indian to be a part from the Malaya citizens during that time. The government accepted the condition and now we are. We have proven to the British that we can still move forward as a developing country without their assent and together with all the races, Malays, Chinese and Indians. This is one of the evidence whereby Malaysia is not swap out the other races.


We are not having Ethnic Cleansing in Malaysia. As for the war in Kosovo during 90’s, the Serbians killed all the Albanians. Is there any racial murder as the Račak Incident in Malaysia? These can be said as Ethnic Cleansing. Are we having this in Malaysia? Tell us one if there’s any. Do not say anything without prove and evidence.


Its for us to think about this country Malaysia. Do we want the 13 May event happened again after we are achieving our 50th Independent Day this year?
